A commercial or general building contractor moving into Montana faces the same filing as everyone else, because the state tests nobody. The department's Requirements and Application Checklist sets out eligibility in full: submit the complete application form with all required fees and documentation, pay $70, and observe the unprofessional conduct rule. There is no trade examination, no business and law examination, no experience or education requirement, no classification, no monetary limit, no surety bond and no net worth or financial statement, so holding an unlimited or Class A license in another state neither waives nor shortens anything here. What the department reviews is workers' compensation compliance, which is the reason the credential exists. Apply online at ebiz.mt.gov/pol; the application stays open for one year from submission and renewal falls on the anniversary of issuance for another $70. A contractor who will work in Montana without employees applies instead for an Independent Contractor Exemption Certificate, which costs $125 and lasts two years.

Because there is no examination at this level, the NASCLA Accredited Examination for Commercial General Building Contractors has nothing to displace in Montana. The department links to NASCLA's website from its contractor pages as a member agency, but it publishes no acceptance of the examination and its checklist, FAQ, forms library and license information page make no mention of it, so a NASCLA transcript neither helps nor is needed. Montana Code Annotated 37-1-304 allows licensure by endorsement and, as amended in 2025, applies to department programs as well as to boards; it measures the origin state's education, examination and experience requirements against Montana's, and this license has none of the three, so there is no deficiency to cure and no step to waive. The department's published Substantial Equivalency Determinations document, linked from this program's own site, covers boards and programs from Allied Health to the State Electrical Board and contains no construction contractor table. The department publishes no reciprocity agreement, no verification-of-licensure form and no processing time for this credential.   • The business must be one the chapter covers. A construction business with employees must be licensed, and so must a corporation or a manager-managed limited liability company whatever its employee count. An independent contractor with no employees is exempt and may register voluntarily; Twenty-four statutory exemptions apply, among them federal-jurisdiction work, utility work incidental to its own business, and a single job under $2,500 that is not part of a larger operation.MCA 37-45-104 also exempts Montana-licensed electricians and plumbers within the scope of their own licenses, Montana-licensed architects, engineers and land surveyors acting solely in a professional capacity, water well contractors, contract security companies, fire suppression and fire protection licensees, contractors building forest access roads in the logging industry, and majority tribal-owned businesses working solely within reservation boundaries.
  • Conduct history is the only part of an applicant's past the department examines. Under MCA 37-45-201(2) and 37-1-137, grounds for disciplinary action against the owner, partners, corporate officers, LLC managers or members named on the application may, in appropriate circumstances, support denial of the license or the issue of a probationary license for up to one year, decided through a contested case hearing. Years in the trade, project size and licenses held elsewhere are not assessed.

  1. 1Application fee. Pay the application fee ($70). Application fee of $70, nonrefundable, set by the department under ARM 24.227.401 and published on the program's license information page and in its FAQ. Renewal costs the same $70, falls on the anniversary of issuance and opens 60 days before the license expires.   2. 2Insurance. Carry the required insurance. Proof of compliance with Montana's workers' compensation laws, required by MCA 37-45-201(1)(b) and the single substantive item the department reviews. An out-of-state policy must be written by an insurer authorized to write Montana workers' compensation coverage, must name the same business and federal employer identification number as the application, and must list Montana specifically in section 3A; the department states that a policy listing Montana only in section 3C is not accepted, and that an 'all other states' endorsement is not accepted for a business engaged in construction. Proof is a signed policy declarations page, or a certificate of insurance from the insurer validated within 20 days by a declarations page. Contractors from Wyoming, Idaho or South Dakota who already hold a policy and are working in Montana temporarily may ask the department for an extraterritorial agreement instead.   3. 3Business license. Obtain a business license. Register the business name with the Montana Secretary of State on (406) 444-3665 if it is anything other than your own personal name, and register the entity itself if it is a corporation, limited liability company or limited partnership; the department verifies the business structure and principals against that filing and asks for the registered agent on the application. The department advises completing this step before submitting the license application. A partnership or joint venture is treated as licensed if the general partner or venturer whose name the business trades under is licensed (MCA 37-45-205). Any change of ownership, business name, officers, members or partners must be reported to the department within 30 days..
  4. 4Surety bond. Post a surety bond (if applicable). No surety bond is required for this license. MCA 37-45-204 makes the chapter's licensing provisions exclusive and bars a political subdivision from requiring a registration, license or bond for the same or a similar purpose, while leaving local governments free to levy a general and nondiscriminatory business license fee that applies to all businesses.   5. 5Other. Independent Contractor Exemption Certificate, $125 and nonrefundable, valid for two years, for a contractor who will work in Montana without employees, and for a sole proprietor, working partner, working member of a member-managed LLC or manager of a manager-managed construction LLC who works away from a fixed business location and is not personally covered by a Montana workers' compensation policy. It is an alternative to the license rather than an addition to it, and the only alternative to self-elected workers' compensation coverage. No test is required; the applicant swears to being free from control or direction and to running an independently established business, and files documentation worth 15 points for each occupation listed. A granted certificate waives the holder's rights and benefits under the Workers' Compensation Act for work done under it; working without either credential carries penalties of up to $5,000 per violation. Montana's unlimited tier is the same single credential as its residential one: the Construction Contractor License issued by the Department of Labor & Industry. The statutory definition in MCA 37-45-102 reaches anyone who offers, undertakes or bids to construct, alter, repair, add to, subtract from, improve, move, wreck or demolish for another a building, highway, road, railroad, excavation or other structure, project, development or improvement attached to real estate, and it also catches an owner who employs members of more than one trade on a single job or under a single building permit. Commercial buildings, highway and heavy work and demolition therefore need no license that a homebuilder does not need, and there is no classification to choose, no monetary limit, no financial statement and no bond. The license is issued to the business, not to a qualifying individual, and the application asks for identity information, the federal employer identification number, the names and addresses of the owner, partners, corporate officers or LLC managers or members, and proof of compliance with Montana's workers' compensation laws. House Bill 239 (Chapter 644, Laws of 2025) converted the former Construction Contractor Registration into this licensing program effective January 1, 2026, moving it into Title 37 and carrying over every registration active on December 31, 2025. Businesses with employees must hold it, as must corporations and manager-managed limited liability companies whatever their employee count, and MCA 37-45-204 keeps cities and counties from issuing a competing contractor license or bond. Trade licensing sits alongside it: Montana-licensed electricians and plumbers are exempt while working inside the scope of their own licenses, which are issued by separate boards with their own examinations.
