A commercial or general building contractor moving into Montana faces the same filing as everyone else, because the state tests nobody. The department's Requirements and Application Checklist sets out eligibility in full: submit the complete application form with all required fees and documentation, pay $70, and observe the unprofessional conduct rule. There is no trade examination, no business and law examination, no experience or education requirement, no classification, no monetary limit, no surety bond and no net worth or financial statement, so holding an unlimited or Class A license in another state neither waives nor shortens anything here. What the department reviews is workers' compensation compliance, which is the reason the credential exists. Apply online at ebiz.mt.gov/pol; the application stays open for one year from submission and renewal falls on the anniversary of issuance for another $70. A contractor who will work in Montana without employees applies instead for an Independent Contractor Exemption Certificate, which costs $125 and lasts two years.

Because there is no examination at this level, the NASCLA Accredited Examination for Commercial General Building Contractors has nothing to displace in Montana. The department links to NASCLA's website from its contractor pages as a member agency, but it publishes no acceptance of the examination and its checklist, FAQ, forms library and license information page make no mention of it, so a NASCLA transcript neither helps nor is needed. Montana Code Annotated 37-1-304 allows licensure by endorsement and, as amended in 2025, applies to department programs as well as to boards; it measures the origin state's education, examination and experience requirements against Montana's, and this license has none of the three, so there is no deficiency to cure and no step to waive. The department's published Substantial Equivalency Determinations document, linked from this program's own site, covers boards and programs from Allied Health to the State Electrical Board and contains no construction contractor table. The department publishes no reciprocity agreement, no verification-of-licensure form and no processing time for this credential.   • The business must be one the chapter covers. A construction business with employees must be licensed, and so must a corporation or a manager-managed limited liability company whatever its employee count. An independent contractor with no employees is exempt and may register voluntarily; Twenty-four statutory exemptions apply, among them federal-jurisdiction work, utility work incidental to its own business, and a single job under $2,500 that is not part of a larger operation.MCA 37-45-104 also exempts Montana-licensed electricians and plumbers within the scope of their own licenses, Montana-licensed architects, engineers and land surveyors acting solely in a professional capacity, water well contractors, contract security companies, fire suppression and fire protection licensees, contractors building forest access roads in the logging industry, and majority tribal-owned businesses working solely within reservation boundaries.
  • Conduct history is the only part of an applicant's past the department examines. Under MCA 37-45-201(2) and 37-1-137, grounds for disciplinary action against the owner, partners, corporate officers, LLC managers or members named on the application may, in appropriate circumstances, support denial of the license or the issue of a probationary license for up to one year, decided through a contested case hearing. Years in the trade, project size and licenses held elsewhere are not assessed.

What you'll do to get licensed in Montana

  1. 1Application fee. Pay the application fee ($70). Application fee of $70, nonrefundable, set by the department under ARM 24.227.401 and published on the program's license information page and in its FAQ. Renewal costs the same $70, falls on the anniversary of issuance and opens 60 days before the license expires. Applications and renewals are filed online at ebiz.mt.gov/pol, and an application expires one year after it is first submitted to the department..
  2. 2Insurance. Carry the required insurance. Proof of compliance with Montana's workers' compensation laws, required by MCA 37-45-201(1)(b) and the single substantive item the department reviews. An out-of-state policy must be written by an insurer authorized to write Montana workers' compensation coverage, must name the same business and federal employer identification number as the application, and must list Montana specifically in section 3A; the department states that a policy listing Montana only in section 3C is not accepted, and that an 'all other states' endorsement is not accepted for a business engaged in construction. Proof is a signed policy declarations page, or a certificate of insurance from the insurer validated within 20 days by a declarations page. Contractors from Wyoming, Idaho or South Dakota who already hold a policy and are working in Montana temporarily may ask the department for an extraterritorial agreement instead.   3. 3Business license. Obtain a business license. Register the business name with the Montana Secretary of State on (406) 444-3665 if it is anything other than your own personal name, and register the entity itself if it is a corporation, limited liability company or limited partnership; the department verifies the business structure and principals against that filing and asks for the registered agent on the application. The department advises completing this step before submitting the license application. A partnership or joint venture is treated as licensed if the general partner or venturer whose name the business trades under is licensed (MCA 37-45-205). Any change of ownership, business name, officers, members or partners must be reported to the department within 30 days..
  4. 4Surety bond. Post a surety bond (if applicable). No surety bond is required for this license. MCA 37-45-204 makes the chapter's licensing provisions exclusive and bars a political subdivision from requiring a registration, license or bond for the same or a similar purpose, while leaving local governments free to levy a general and nondiscriminatory business license fee that applies to all businesses. Bonding on individual public and private contracts is a separate matter set by the owner and by public works law..
  5. 5Other. Independent Contractor Exemption Certificate, $125 and nonrefundable, valid for two years, for a contractor who will work in Montana without employees, and for a sole proprietor, working partner, working member of a member-managed LLC or manager of a manager-managed construction LLC who works away from a fixed business location and is not personally covered by a Montana workers' compensation policy. It is an alternative to the license rather than an addition to it, and the only alternative to self-elected workers' compensation coverage. No test is required; the applicant swears to being free from control or direction and to running an independently established business, and files documentation worth 15 points for each occupation listed. A granted certificate waives the holder's rights and benefits under the Workers' Compensation Act for work done under it; working without either credential carries penalties of up to $5,000 per violation. Montana's unlimited tier is the same single credential as its residential one: the Construction Contractor License issued by the Department of Labor & Industry. The statutory definition in MCA 37-45-102 reaches anyone who offers, undertakes or bids to construct, alter, repair, add to, subtract from, improve, move, wreck or demolish for another a building, highway, road, railroad, excavation or other structure, project, development or improvement attached to real estate, and it also catches an owner who employs members of more than one trade on a single job or under a single building permit. Commercial buildings, highway and heavy work and demolition therefore need no license that a homebuilder does not need, and there is no classification to choose, no monetary limit, no financial statement and no bond. The license is issued to the business, not to a qualifying individual, and the application asks for identity information, the federal employer identification number, the names and addresses of the owner, partners, corporate officers or LLC managers or members, and proof of compliance with Montana's workers' compensation laws. House Bill 239 (Chapter 644, Laws of 2025) converted the former Construction Contractor Registration into this licensing program effective January 1, 2026, moving it into Title 37 and carrying over every registration active on December 31, 2025. Businesses with employees must hold it, as must corporations and manager-managed limited liability companies whatever their employee count, and MCA 37-45-204 keeps cities and counties from issuing a competing contractor license or bond. Trade licensing sits alongside it: Montana-licensed electricians and plumbers are exempt while working inside the scope of their own licenses, which are issued by separate boards with their own examinations.

Oklahoma has no statewide general, commercial or unlimited building contractor license, and the Construction Industries Board publishes that finding itself: "General Contractors are not currently required to have a state license in Oklahoma for general contracting", with the rider that trade licenses and registrations are still required for licensed trade work and that local jurisdictions should be contacted for local requirements. The CIB regulates plumbing, electrical, mechanical, roofing, building and construction inspectors, and home inspectors, and nothing else; the Oklahoma Uniform Building Code Commission adopts the statewide building codes that local departments enforce. The one statewide credential a general contractor may still need in its own right is the CIB roofing contractor registration, which reaches resident and non-resident contractors alike and carries a commercial endorsement with a PSI examination, a $230 initial fee and $1,000,000 of liability insurance for commercial roofing. Commercial building itself is a city matter and the requirements are administrative. Edmond states that "a general building contractor's license is required for permit submittal" and issues one on an email filing, Broken Arrow registers general contractors on a $50,000 liability certificate and a workers' compensation filing, and Tulsa registers contractor accounts by trade with an insurance undertaking. Oklahoma City is the notable gap: its only building category is Building Contractor (Residential Only), so a commercial builder there registers no general credential at all, and Norman licenses only trade, sign and structure moving contractors. None of these carries a trade or business-law exam, a bond, a qualifying party or a financial statement, and there is no NASCLA route because Oklahoma has no state board to accept one.

How local licensing works in Oklahoma

How local licensing works. No Oklahoma agency licenses general or commercial building contractors, so there is no state application to file, no state qualifying party and no state examination. The Construction Industries Board's own FAQ puts it plainly - "General Contractors are not currently required to have a state license in Oklahoma" - and directs contractors to check "the jurisdiction in which you are interested in performing construction related work", noting that other agencies such as the Corporation Commission, the Oklahoma Department of Labor and the Oklahoma Liquefied Petroleum Gas Board license other construction-related areas. Statewide commercial and residential building codes come from the Oklahoma Uniform Building Code Commission and are enforced locally.

Roofing, and only roofing, is a statewide registration. A commercial builder self-performing roofing needs a CIB roofing contractor registration plus a commercial endorsement. The registration is $75 initially and annually, needs at least $500,000 of general liability insurance naming the board as certificate holder, workers' compensation coverage or exemption, Secretary of State business-name registration, entity documents and an affidavit of lawful presence, and runs through a qualifying party who is an owner, officer, member or general partner actively engaged in the work. The commercial endorsement costs $230 initially and $100 to renew, requires a roofing registration in good standing first, raises the liability minimum to $1,000,000, and requires a PSI examination once the application is approved. Commercial roofers also complete four hours of approved continuing education every 36 months. Registration is non-transferable and applies to non-resident contractors as much as to Oklahoma firms.

Oklahoma City. There is no general or commercial building registration. The city's contractor registration categories are Boiler, Building Contractor (Residential Only), Electrical, Fence, House Moving, Insulation, Mechanical, Plumbing, Prequalified Contractor and Sidewalk Contractor (both through Public Works), and Sign. A commercial builder pulls permits without a city contractor credential, while the electrical, mechanical and plumbing scope goes to contractors registered on current CIB state licenses and boiler work to a contractor licensed by the Oklahoma Department of Labor. Tulsa. The Permit Center "registers the licenses of trade contractors" and issues trade permits; the city's guide to doing business states that "in Oklahoma there is no general license required to start or own a business or to operate as a general contractor" and that the state-licensed trades - electrical, fire, mechanical and plumbing - "must then register with the City of Tulsa." Registration is an account filing on the Account Information and Contractor Registration form, whose trade checkboxes include Building alongside the state-licensed trades, demolition, house moving, fire protection systems, and sidewalk, driveway and paving cut work; the last of those "requires an Annual Contractor's Contract with City of Tulsa." The state control number is requested only "if applicable", and the substantive undertaking is to carry general liability insurance naming the City of Tulsa as an additional insured with 30 days' written notice of cancellation. Stationary engineers are the one credential Tulsa tests itself, on a certificate of competency. Pre-development meetings cost $350 for the Infrastructure Development Process route and $350 for the Code Compliance route, each credited against later fees. Norman. Norman licenses trade contractors, sign contractors and structure movers and nothing else. A Trade Contractor license for electrical, mechanical or plumbing work requires a current active CIB state license, shown active on the CIB website, plus photo ID, renewed annually by 31 March. A Sign Contractor license requires a $2,000 surety bond or certificate of deposit on the city's bond form. A Structure Moving license requires casualty insurance of at least $100,000 and proof of unified carrier registration or an intrastate license. There is no general or commercial building contractor license, so a commercial builder works through the online permitting portal and the licensed trades. Development Services, (405) 366-5339.

Broken Arrow. The Community Permitting and Licensing Division issues residential and commercial building permits and registers contractors through the Citizen Self Service portal. The General Contractor Registration form requires only a current general liability insurance certificate with the business name and address, the City of Broken Arrow named as certificate holder and minimum $50,000 coverage; a current workers' compensation certificate or an Affidavit of Exemption from the Oklahoma Workers' Compensation Commission; the city named as certificate holder on every certificate; and a copy of the contractor's driver's license. Edmond. Building & Fire Code Services states that "a general building contractor's license is required for permit submittal" and opens a new one on an email giving the company name, mailing address, contact phone number and portal email. Residential building contractors hold a separate license and "must maintain current general liability and workman's compensation for permit submittal." Trade contractors "are required to hold active city and state licenses" and file their CIB license and driver's license; trade licenses expire 31 July, renew through the portal from July through August, and lapse on 1 September if unpaid. No exam, bond, experience requirement or fee is published for the general building license, so confirm what is payable before submitting. 22 E. What does and does not travel. An out-of-state general contractor license, a NASCLA Accredited Examination and out-of-state project experience carry no weight anywhere in Oklahoma, because no Oklahoma authority tests or qualifies commercial builders and Oklahoma is not a NASCLA participating state. What does travel is the CIB credential set: the roofing contractor registration, which the Roofing Contractor Registration Act applies to non-resident contractors by name, and the plumbing, electrical and mechanical licenses that several of the cities above demand before they will register a trade contractor.
