Out-of-state residential contractor without a reciprocal agreement (all states except AL, LA, MS, NC and TN)

Your out-of-state credentials give no advantage. You meet the destination's requirements from scratch.

A home builder or remodeler licensed in a state that has no reciprocal agreement with Arkansas files the ordinary new application for the license wanted and is reviewed by the Residential Contractors Committee case by case. The out-of-state license still helps: under 17 CAR § 295-107(d) an applicant who holds a substantially equivalent license in good standing in another jurisdiction is not required to demonstrate experience, which removes the four-year builder or two-year remodeler showing and the three reference forms, and 17 CAR § 295-101 allows a ninety-day temporary license on a completed application while the full application is reviewed. What is not removed is the Arkansas Business and Law examination, a fifty-question, two-hour open-book examination delivered by PSI on the NASCLA Contractors Guide to Business, Law and Project Management, Arkansas Edition, which the qualifying party must pass before the license is released. The applicant also files a compiled balance sheet showing positive net worth (not required of a limited remodeler), Secretary of State filings for the entity, and a workers' compensation certificate if the business has employees. A separate route exists for anyone who has established residence in Arkansas: Ark. Code Ann. § 17-7-104 obliges the Board to grant automatic occupational licensure to the holder in good standing for one year of a similar-scope license from another state, although the Board may still require the state-law examination and must still require the financial statement.

Arkansas has no trade examination for a residential contractor license; the Arkansas Business and Law examination is the only examination the Committee requires, which is why examTradeRequired is false and examLawRequired is true. The Board does not publish the passing score for that examination, the number of attempts allowed, or a processing time; applications must reach the Board three weeks before a committee meeting and must be completed within ninety days of receipt or the filing fee is forfeited. Uniformed service members, veterans and their spouses who hold a similar out-of-state license are exempt from both the experience showing and the examination under 17 CAR § 295-116(c). The Board's published NASCLA material covers the Commercial General Building Contractor examination and is authored on the general level of this page; whether it will also be accepted as 'the appropriate examination' in place of residential experience under 17 CAR § 295-107(a)(1)(C) is not stated in any Board document, so ask the Board at (501) 372-4661 before paying for that examination.   5. 5Insurance. Carry the required insurance. Current certificate of workers' compensation insurance if the applicant has one or more employees. Ark. Code Ann. § 17-25-514 requires a contractor licensed by the Residential Contractors Committee to secure and maintain coverage under § 11-9-401 et seq. The license is issued to a legal entity, so a corporation, LLC, LP or LLP must file its Articles or filings from the Secretary of State's office with the application, together with any fictitious name registration. Arkansas licenses home builders statewide through the Residential Contractors Committee of the Arkansas Contractors Licensing Board, under Ark. Code Ann. § 17-25-501 et seq. A Residential Building Contractor license covers new construction of a single-family residence of one to four units, and a Residential Remodeler license covers alterations, additions, repairs and demolition on an existing single-family residence; either is required once the cost of the work, including labor and material, exceeds $2,000, and that threshold cannot be avoided by splitting a job into smaller contracts. The license belongs to the business rather than the person: it is issued to an individual, corporation, LLC, partnership, LP or LLP and is supported by a qualifying party, an owner, officer, actively engaged member or full-time employee who personally passes the examination, so an inbound builder applies as or for the entity that will sign contracts. Eligibility rests on four years of verifiable building experience for a builder license or two years for a remodeler license, evidenced by three references from people who have seen the work, plus the Arkansas Business and Law examination, a compiled balance sheet showing positive net worth, and workers' compensation cover if the business has employees. An applicant who already holds a substantially equivalent license in good standing in another jurisdiction does not have to demonstrate experience at all, and five states have signed reciprocal agreements that go further and waive the examination as well. Oklahoma issues no statewide residential building, home builder or home improvement contractor license, and the Construction Industries Board says so on its own home page: "General Contractors are not currently required to have a state license in Oklahoma for general contracting. However, trade licenses/registrations are required for performing, or offering to perform, licensed/registered trade work. Further, local jurisdictions should be contacted for any local requirements." What the CIB does regulate is plumbing, electrical, mechanical, roofing, building and construction inspectors, and home inspectors. One of those is genuinely statewide for a residential contractor: roofing. Under the Roofing Contractor Registration Act, resident and non-resident roofing contractors alike must hold a CIB roofing contractor registration before they engage in or offer roofing services anywhere in Oklahoma, which costs $75, runs through a named qualifying party and needs at least $500,000 of liability insurance; failing to register is a misdemeanor. Everything else about housing is local. Oklahoma City registers a Building Contractor (Residential Only) for $100 on insurance alone, Edmond issues a separate residential building contractor license conditioned on current general liability and workers' compensation, and Broken Arrow registers general contractors on a $50,000 liability certificate. Tulsa and Norman license only the trades and leave the homebuilder to pull permits without a city contractor credential. None of these involves an exam, a bond, experience or a financial statement, and none of them gives credit for a license held in another state, so an inbound residential builder registers in each city where permits will be pulled, registers with the CIB if roofing is in scope, and makes sure any plumbing, electrical or mechanical work is performed under the right CIB license.

How local licensing works in Oklahoma

How local licensing works. Oklahoma has no state homebuilder or remodeler license, no state qualifying party for building work and no state reciprocity for it. Statewide residential and commercial building codes are adopted by the Oklahoma Uniform Building Code Commission and enforced by local building departments, so the contractor rules come from each city. Identify the city or county with jurisdiction over the address, register there, and expect to repeat the filing in the next jurisdiction. Two state obligations follow the contractor everywhere: a CIB roofing contractor registration for any roofing work, and a CIB plumbing, electrical or mechanical license for any of that work that is self-performed.

Roofing is the statewide exception. The Roofing Contractor Registration Act "creates a procedure whereby resident and nonresident roofing contractors are required to obtain a valid registration from the CIB in order to engage in or offer to engage in roofing-related services in the State of Oklahoma", and "failure to register is a misdemeanor punishable by a fine of up to $500.00." Registration is $75 initially and $75 to renew each year, and requires a general liability certificate of at least $500,000 naming the Construction Industries Board as certificate holder and specifically covering roofing work, proof of workers' compensation coverage or exemption, the business name registered with the Oklahoma Secretary of State, entity formation documents, and an affidavit of lawful presence. A qualifying party must be at least 18, must be an owner, officer, member or general partner, and must be "actively engaged in the work undertaken by the registrant." Registrations are non-transferable. A residential-only roofer stops there: "roofing contractors who do not perform commercial roofing contractor work and only perform residential roofing contractor work do not need to obtain a commercial endorsement."

Oklahoma City. Development Services registers contractors under Chapter 12 of the Municipal Code. The residential category is Building Contractor (Residential Only), defined as "any person contracting to make or provide any beneficial or valuable change or addition, betterment, enhancement, or amelioration of upon or to any new, proposed or existing structure on private property for which a building permit is required." The filing is a general liability certificate of at least $50,000 per occurrence, workers' compensation of at least $100,000 per occurrence or an Oklahoma Workers' Compensation Commission Affidavit of Exempt Status, an immigration affidavit where applicable, and a $100 registration fee. There is no bond, exam or experience requirement. Electrical, mechanical and plumbing contractors register separately and must show a current CIB state license first; boiler contractors must hold Oklahoma Department of Labor licensure. Tulsa. The Development Services Permit Center "permits all development within the city and registers the licenses of trade contractors", and the city's own guide states that "the State of Oklahoma licenses trade contractors (electrical, fire, mechanical, and plumbing) who must then register with the City of Tulsa." Registration is done on an Account Information and Contractor Registration form whose trade list includes Building, Mechanical, Plumbing, Electrical, commercial fire sprinkler, fire alarm, house moving, demolition, fire extinguisher and suppression systems, and sidewalk, driveway and paving cut work; the state control number field is marked "if applicable", and the account carries an undertaking to provide general liability insurance naming the City of Tulsa as an additional insured with 30 days' notice of cancellation. There is no exam, bond, experience or financial requirement on the form, and the city no longer registers journeymen, apprentices or sign and electrical sign contractors. Permits that require a contractor license must be applied for through the contractor's own portal login. Norman. The city licenses three things and a homebuilder is not one of them. Trade Contractor licenses for electrical, mechanical and plumbing require a current active CIB state license in hand and shown active on the CIB site, plus a driver's license or state ID; they renew annually on notices mailed in mid-February with a 31 March due date. A Sign Contractor license requires a $2,000 corporate surety bond or certificate of deposit on the city's own bond form, renewed annually. A Structure Moving license requires a casualty insurance certificate of at least $100,000 and proof of unified carrier registration or an intrastate license. Broken Arrow. The Community Permitting and Licensing Division handles residential and commercial building permits, sign permits, zoning cases and contractor registration through the Citizen Self Service portal. The city's General Contractor Registration form asks for four things and nothing else: a current general liability insurance certificate showing the business name and address, naming the City of Broken Arrow as certificate holder, with minimum $50,000 coverage; a current workers' compensation certificate or an Affidavit of Exemption; the City of Broken Arrow named as certificate holder on every certificate of insurance; and a copy of the contractor's driver's license. There is no exam, bond, experience requirement or state license prerequisite, and the form prints no fee, so confirm the current amount before filing. Community Development, P.O. Edmond. Building & Fire Code Services is the one Oklahoma jurisdiction on this page that separates the two tiers explicitly. "Residential building contractors must maintain current general liability and workman's compensation for permit submittal", and a new residential building contractor license is opened by emailing the office the company name, mailing address, contact phone number, current general liability insurance, current workers' compensation and the portal email. A general building contractor license is a separate credential. Trade contractors "are required to hold active city and state licenses" and file their current CIB license and driver's license. Trade licenses expire on 31 July each year, renew from July through August through the portal, and lapse on 1 September if unpaid. Everywhere else. Smaller Oklahoma cities and rural counties vary from a full registration program to nothing beyond a building permit. Where a jurisdiction has not adopted a state-recognized code, does not require permits and employs no inspector, a contractor installing, modifying or altering plumbing, electrical or mechanical systems must file a Notification of Work Without Permit with the CIB instead.
