A residential builder arriving in Montana takes the same short route as a Montana builder starting out, because the state asks nobody to prove skill. The department's Requirements and Application Checklist lists the whole of eligibility: submit the complete application form with all required fees and documentation, pay $70, and observe the unprofessional conduct rule. There is no trade examination, no business and law examination, no apprenticeship, no minimum experience, no education requirement, no surety bond, no net worth or financial statement and no classification to apply for, so an out-of-state contractor license, however demanding the state that issued it, buys no advantage here and no step is waived or shortened by it. The one substantive condition is workers' compensation: the license exists to keep construction employers inside the Workers' Compensation Act, and proof of compliance is what the department actually reviews. Apply online at ebiz.mt.gov/pol; the application stays open for one year from the day it is submitted, and renewal falls on the anniversary of issuance for another $70. A contractor who will work alone in Montana, with no employees, applies for an Independent Contractor Exemption Certificate instead for $125.

Which of the two credentials you need turns on whether you will have employees in Montana, not on where you came from. A construction business with employees, and every corporation and manager-managed LLC whatever its employee count, takes the Construction Contractor License. A sole proprietor, a working partner, a working member of a member-managed LLC, or a manager of a manager-managed construction LLC who performs services away from a fixed business location and is not personally covered by a Montana workers' compensation policy takes an Independent Contractor Exemption Certificate, which lasts two years, costs $125, requires no test, and is granted on documentation of an established business rather than on trade skill. The certificate waives all the holder's rights and benefits under the Workers' Compensation Act, so it is a real choice, not a formality, and a hiring agent who engages someone without either credential risks being treated as that person's employer. Montana Code Annotated 37-1-304 allows licensure by endorsement, and since 2025 it applies to department programs as well as to boards, but it measures another state against Montana's education, examination and experience requirements, and this license has none of the three; the department's published Substantial Equivalency Determinations document contains no construction contractor table. For the same reason the NASCLA Accredited Examination has nothing to waive here: the department links to NASCLA's website but publishes no acceptance of the examination, because no Montana contractor examination exists.   • The business must be one the chapter covers. A construction business with employees must be licensed, and so must a corporation or a manager-managed limited liability company whatever its employee count. An independent contractor with no employees is exempt from the license and may register voluntarily; an owner working on the owner's own property is exempt unless the improvement is built for prompt sale, and a single job worth less than $2,500 is exempt unless it is part of a larger operation.MCA 37-45-104 lists twenty-four exemptions, including Montana-licensed electricians and plumbers working within the scope of their own license, Montana-licensed architects and engineers acting in a professional capacity, water well contractors, fire protection licensees and majority tribal-owned businesses working solely within reservation boundaries.
  • Conduct history is the only part of an applicant's past the department examines. Under MCA 37-45-201(2) and 37-1-137, grounds for disciplinary action against the owner, partners, corporate officers, LLC managers or members named on the application may, in appropriate circumstances, support denial of the license or the issue of a probationary license for up to one year, decided through a contested case hearing. Trade history, hours worked and prior licenses in other states are not assessed.

  2. 2Insurance. Carry the required insurance. Proof of compliance with Montana's workers' compensation laws, required by MCA 37-45-201(1)(b) and the single substantive item the department reviews. An out-of-state policy must be written by an insurer authorized to write Montana workers' compensation coverage, must name the same business and federal employer identification number as the application, and must list Montana specifically in section 3A; the department states that a policy listing Montana only in section 3C is not accepted, and that an 'all other states' endorsement is not accepted for a business engaged in construction.   3. 3Business license. Obtain a business license. Register the business name with the Montana Secretary of State on (406) 444-3665 if it is anything other than your own personal name, and register the entity itself if it is a corporation, limited liability company or limited partnership; the department verifies the business structure and principals against that filing and asks for the registered agent on the application. The department advises completing this step before submitting the license application. A partnership or joint venture is treated as licensed if the general partner or venturer whose name the business trades under is licensed (MCA 37-45-205).   4. 4Surety bond. Post a surety bond (if applicable). No surety bond is required for this license. MCA 37-45-204 makes the chapter's licensing provisions exclusive and bars a political subdivision from requiring a registration, license or bond for the same or a similar purpose, while leaving local governments free to levy a general and nondiscriminatory business license fee that applies to all businesses. Independent Contractor Exemption Certificate, $125 and nonrefundable, valid for two years, for a contractor who will work in Montana without employees, and for a sole proprietor, working partner, working member of a member-managed LLC or manager of a manager-managed construction LLC who works away from a fixed business location and is not personally covered by a Montana workers' compensation policy. It is an alternative to the license rather than an addition to it, and the only alternative to self-elected workers' compensation coverage. Montana has one construction contractor credential and it is the same at every level: the Construction Contractor License issued by the Department of Labor & Industry. There is no separate residential or homebuilder class, no classification list, no dollar ceiling and no examination. Building a house, remodeling one, roofing, siding, flooring and demolition all sit inside the single definition in MCA 37-45-102, and the same license covers commercial work. The license is held by the business rather than by a named qualifying individual, and the application asks only for identity information, the federal employer identification number, the names and addresses of the owner, partners, corporate officers or LLC members, and proof of compliance with Montana's workers' compensation laws. Until December 31, 2025 this credential was called Construction Contractor Registration; House Bill 239 (Chapter 644, Laws of 2025) moved it into Title 37 as a department licensing program effective January 1, 2026 and converted every registration that was active on that date. It is required of construction businesses with employees, and of corporations and manager-managed limited liability companies whatever their employee count; an independent contractor with no employees is exempt and works instead under an Independent Contractor Exemption Certificate or a self-elected workers' compensation policy, though that person may choose to be licensed. Electricians and plumbers licensed in Montana are exempt while working inside the scope of their own license, as is any single job under $2,500, and MCA 37-45-204 bars a city or county from requiring its own contractor license or bond.
