Everyone registers the same way; an out-of-state contractor license transfers nothing

Your out-of-state credentials give no advantage. You meet the destination's requirements from scratch.

A commercial or general contractor licensed in another state gains nothing from that license in Iowa and loses nothing by not having one. DIAL does not evaluate out-of-state credentials for contractor registration, publishes no reciprocity or endorsement route, and has nothing to waive, because Iowa holds no contractor examination and sets no experience requirement. Iowa is not one of the state agencies that accept the NASCLA Accredited Examination for Commercial General Building Contractors, for the same reason. The one way an arriving contractor is treated differently is the bond: a business whose principal place of business is in another state must file a continuous $25,000 surety bond on DIAL's bond form, from a surety licensed in Iowa, or show that the Iowa Department of Transportation has prequalified it to bid on department projects. A branch office in Iowa does not change that, and every out-of-state subcontractor registers and bonds separately rather than working under the general contractor's registration. Otherwise the route is identical for everyone: get an Iowa unemployment insurance employer account number, file the workers' compensation certificate naming DIAL as certificate holder or a statement that coverage is not required, file the application with the ownership and business details, and pay $50 for a year or $150 for three. The number is issued within 30 days, and no work may start before it arrives.

Whether a business is out-of-state for bonding purposes turns on the seven factors in 481 IAC 465.2 - where the home office is shown on government filings, where payroll is prepared, where business is transacted, where the officers or owners live and work, where the bank accounts are, where fixed business property is, and where management decisions are made - rather than on where the company is incorporated. The $25,000 figure is a tax and unemployment-contribution guarantee running to the State of Iowa, not a measure of capacity or a performance bond, so a commercial contractor will still need separate bid, performance and payment bonds by contract or under the public works statutes. DIAL may require a larger bond after a hearing if the department of revenue or DIAL finds the state's tax exposure greater than the bond. Working or bidding without a registration draws a citation of up to $500 for a first violation and up to $5,000 for each later one, with 15 working days to contest before the employment appeal board.   • Registration is required of every contractor doing business in Iowa that earns at least $2,000 a year from construction, including out-of-state businesses, joint ventures, construction management firms, design-builders and every subcontractor on the job.Iowa Code 91C.1(1)(a) and 91C.2; 481 IAC 465.1 and 465.3. The scope of 'construction' comes from 871 IAC 23.82(96), which covers building construction, land subdivision and development, heavy construction such as highways, power plants and pipelines, and special trade contracting, and which names general contractors, design-builders, engineer-constructors, joint-venture contractors, turnkey construction contractors and construction management firms.
  • No examination result, trade experience, education, apprenticeship, reference or financial statement is asked for at any point, so an out-of-state general contractor license, a NASCLA examination transcript and documented years in business are all equally irrelevant to the decision.The conditions of registration are exhaustively listed at Iowa Code 91C.2 and the application contents at 481 IAC 465.4; neither mentions qualifications, competency or another jurisdiction's license.
  • A contractor whose principal place of business is in another state must bond. Opening a branch office in Iowa does not make the business an in-state contractor if it is primarily based elsewhere, and the department applies a seven-factor test to decide.Iowa Code 91C.2(3) and 481 IAC 465.2 and 465.4(11). The alternative to the bond is a letter from the Iowa Department of Transportation confirming prequalification to bid on department projects under Iowa Code 314.1.

  1. 1Application fee. Pay the application fee ($50). Contractor registration fee: $50 per year, or $150 for a three-year registration, non-refundable. Registration renews annually, and a renewal form is sent by mail or email the month before expiry; renewing on time keeps the same registration number. A self-employed contractor who does not pay more than $2,000 a year to employ other people and does not work with or for other contractors in the same phase of construction is fee exempt and files a fee exemption form, which must be filed again at each renewal. Credit card and ACH payments are not accepted over the phone. A contractor registering through the Plumbing and Mechanical Systems Board's joint application pays a fee prorated to the length of that licensing period instead..
  2. 2Surety bond. Post a surety bond ($25,000). Out-of-state contractor bond: a $25,000 surety bond on DIAL's own bond form, from a surety company licensed to do business in Iowa, required of every contractor whose principal place of business is in another state, and of every out-of-state subcontractor in its own name. The bond is continuous until the surety cancels it on at least 30 days' written notice to both the contractor and DIAL, and guarantees payment of all taxes, unemployment compensation contributions, penalties, interest and related fees accruing to the State of Iowa from the work. Only the State of Iowa and its agencies may collect on it. DIAL may order the amount increased after a hearing where the state's tax exposure exceeds it. A contractor prequalified by the Iowa Department of Transportation to bid on its projects may file that letter instead.   3. 3Insurance. Carry the required insurance. Workers' compensation: a certificate of insurance from the carrier showing the effective dates of coverage and naming the Department of Inspections, Appeals, and Licensing as certificate holder, filed every year. A self-insured employer files the commissioner of insurance's release under Iowa Code 87.11, and a contractor with no employees files a statement that it is not required to carry coverage. The insurer must notify DIAL of cancellation, the contractor must give DIAL ten days' notice before any change in coverage, and a lapse is grounds to revoke the registration after a fact-finding interview..
  4. 4Business license. Obtain a business license. An Iowa unemployment insurance employer account number from the unemployment insurance services division of Iowa Workforce Development, obtained before the registration application is filed. It is required of in-state and out-of-state contractors alike, even those with no employees. The application also needs a federal employer identification number for a business entity, or the owner's Social Security number for a natural person, and the business's NAICS code or a description of its principal products and services..
  5. 5Other. The registration application, filed through DIAL's online contractor registration portal or on the department's paper form, giving the business name, the mailing address of the principal place of business, the business telephone number, the entity type and the name, address, telephone number and position of each corporate officer or each owner. The registration number - the letter C followed by six digits - issues within 30 days of a complete application, is a public record, and must be obtained before any construction work is performed in Iowa..
  6. 6Other. Separate trade licensing where the work calls for it. Registration does not authorize plumbing, mechanical, HVAC, refrigeration, sheet metal or hydronic work, which needs a contractor license from the Iowa Plumbing and Mechanical Systems Board under chapter 105 - obtained on a joint application that issues the contractor registration number at the same time - or electrical work, which needs a license from the Iowa Electrical Examining Board under chapter 103.   7. 7Other. Registration before permits and before public contracts. A state or local official may not issue a building permit, certificate or authorization to a contractor who is required to hold a contractor registration number and has not obtained one, and a contractor who is not registered may not be awarded a contract to perform work for the state or a state agency. DIAL also directs contractors to contact the city or county government for each project to confirm local requirements, and the Iowa Department of Revenue publishes the sales and use tax rules that apply to construction contractors..

Iowa's commercial and general building tier is the same credential described at the residential level: a single construction contractor registration with the Department of Inspections, Appeals, and Licensing, with no classes, no letters, no monetary limits and no separation between house and commercial work. Iowa does not license general contractors at all. Chapter 91C of the Iowa Code and 481 Iowa Administrative Code chapter 465 set out the whole of what registration takes, and they contain no trade examination, no business-and-law examination, no experience requirement, no net worth or financial statement test, no continuing education and no qualifying party. The scope is set by the employment security definition of construction, which covers building construction, heavy construction such as highways, power plants and pipelines, and every special trade, and which names 'general contractors, design-builders, engineer-constructors, joint-venture contractors, and turnkey construction contractors' among the establishments it reaches. Registration is held by the business, and a joint venture registers as an independent entity in its own right. What the state verifies is compliance rather than competence: an Iowa unemployment insurance employer account number, workers' compensation coverage or a statement that it is not required, a $50 annual fee, and a $25,000 surety bond from any contractor whose principal place of business is outside Iowa. Registration matters commercially as well as legally - a building official may not issue a permit to an unregistered contractor, and an unregistered contractor may not be awarded a contract for work for the state or a state agency. Iowa's real competency licenses are in the trades: electricians under chapter 103 and plumbing, mechanical, HVAC, refrigeration, hydronic and sheet metal contractors under chapter 105.

Texas has no statewide general, commercial or building contractor license and no state board that examines or qualifies builders, so there is nothing at the state level for an out-of-state general contractor's license to transfer into. The trades are licensed instead: the Texas Department of Licensing and Regulation licenses electricians and electrical contractors, air conditioning and refrigeration contractors, elevator and boiler work, water well drillers and industrialized housing and buildings; the Texas State Board of Plumbing Examiners licenses plumbers; and the Texas Department of Insurance State Fire Marshal's Office licenses fire alarm and fire sprinkler contractors. Commercial building is controlled through city permitting: Dallas registers general contractors and says its category expressly includes commercial general contractors, Fort Worth requires a Building Contractor registration for any building permit, El Paso requires a general contractor registration with a blanket construction bond and liability insurance for new commercial work and tenant improvements, and Austin requires the general contractor named on a building permit to register with Building and Trade Contractor Services first. Houston and San Antonio require nothing at all of a commercial general contractor: San Antonio states that 'there are no license or registration requirements for commercial general contractors', and Houston's permitting guides state that general contractors are not required to be licensed. None of these city registrations involves a trade or business-law exam, a qualifying party, a financial statement or an experience review, and none of them recognizes a license from another state, so a general contractor arriving in Texas registers city by city, carries the insurance and bonds each city demands, and makes sure the electrical, HVAC and plumbing work is performed under the correct state trade licenses.

How local licensing works in Texas

How it works in Texas. No Texas agency issues a general, commercial, building or unlimited contractor license, and there is no Texas equivalent of a qualifying party, a NASCLA route or a business-and-law exam. Cities control commercial construction through the building permit. Where a city registers contractors, registration is an annual (or biennial) filing backed by insurance, bonding and identity documents - never a competency exam - so out-of-state experience, an out-of-state license and a NASCLA Accredited Examination score all carry the same weight in Texas, which is none. What does matter is holding, or employing, the state trade licenses for any electrical, HVAC or plumbing scope, and registering those licenses with the city as well.

Dallas. Building Inspection's contractor registration form covers General Contractor and notes that the category 'includes, but is not limited to, the following: residential general contractor, commercial general contractor, roofing contractor, fence contractor, foundation contractor, demolition contractor and pool contractor.' The form prints an annual registration or renewal fee of $120.00. A company with a Dallas address must supply a Certificate of Occupancy number or have a home office form on file. The responsible party lists and assigns PINs to the staff who may sign permit applications, and registrations are suspended or revoked under Chapter 52 of the Dallas City Code, the Administrative Procedures for the Construction Codes. Fort Worth. 'Any firm, business, individual or organization obtaining a permit related to the building, mechanical, plumbing or electrical provisions' of the city codes must have a valid Contractor Registration on file with Development Services. A commercial builder registers as a Building Contractor for $168.75, submitting the application and a copy of a valid driver's license; 'the Contractor Registration, unless revoked or suspended, shall expire one year from the date of issuance.' The Mechanical, Electrical and Plumbing registration types require the matching Texas state license; the Building type does not require any license or exam. Parkway and Utility contractors are the exception that carries a bond ($25,000 commercial or $10,000 residential) and a certificate of liability insurance naming the City as additional insured, at $562.50. El Paso. Planning and Inspections registers a General Contractor for 'New Commercial & Tenant Improvements'. The filing is an Assumed Name Certificate or corporate documents, the Contractor Registration Application, a certificate of general liability insurance of at least $100,000 with the City of El Paso as certificate holder, and a blanket building construction bond; the city's current application states $50,000 for general contractors while its requirements sheet lists $25,000, so confirm the figure with the One Stop Shop before buying the bond. Stated minimum liability limits are $250,000 bodily injury per person, $500,000 aggregate, and $100,000 property damage per occurrence and in the aggregate. The requirements sheet lists a $102.00 annual fee, and the application 'must be filed annually to be eligible to obtain permits from the City of El Paso in accordance with Section 18.02.104.5 of the El Paso City Code.' Austin. Development Services states plainly that 'in Texas, anyone can be a General Contractor, including homeowners, and a state license is not required.' The general contractor named on a building permit must still register with Building and Trade Contractor Services before the permit is activated: create an Austin Build + Connect (AB+C) portal account, submit the registration web form and a Letter of Authorization. General contractors register once and update only on a change of name, address or authorized agents, while trade contractors must hold the state license and refresh their registration annually with the license information. Austin publishes no fee for general contractor registration.

San Antonio. Development Services registers residential builders and home improvement contractors under Chapter 10-115 of the Code of Ordinances, but for commercial work it states: 'There are no license or registration requirements for commercial general contractors.' A commercial builder in San Antonio pulls permits without any city credential; the electrical, mechanical and plumbing subcontractors must be registered with Development Services on their state licenses before permits are issued.

Houston. Houston requires no general contractor credential of any kind. Its Commercial Permitting 101 guide states that 'the building permit may be purchased by the owner, agent, contractor. General Contractors are not required to be licensed', and the city's plan review page repeats that 'a general contractor's license is not required to obtain building permits.' The city instead registers the licensed trades: a TDLR Master Electrician, a TDLR Class A or B air conditioning contractor, a TSBPE Master Plumber, and fire alarm and fire sprinkler contractors licensed by the Texas Department of Insurance State Fire Marshal's Office, each of whom must also be registered with the City of Houston to buy a trade permit. Commercial projects over $50,000 additionally need a TDLR project registration under the Architectural Barriers Act.

Everywhere else. Other Texas cities set their own rules, and outside city limits and extraterritorial jurisdictions there is usually no building permit authority at all. Ask each city's building or development services department what it registers before you bid work there.
